
The Sangguniang Panlalawigan has dismissed the administrative case for abuse of authority and grave misconduct filed against Mabalacat City Mayor Crisostomo Garbo for lack of jurisdiction.
In its decision, the SP’s Committee on Justice, Good Government and Public Accountability for adjudication stated that the case filed by Faustino R. Buenaventura of Mabalacat City against Mayor Garbo for alleged Abuse of Authority, Grave Misconduct and Dishonesty stated that “administrative complaints against any erring elective provincial official of a province, a highly urbanized city, an independent component or component city shall be filed before the Office of the President pursuant to Section 61 (a) of Republic Act No. 7160.”
“As Disciplining Authority, the Sangguniang Panlalawigan dismisses, as it hereby dismisses the instant administrative case against Mayor Crisostomo C. Garbo of Mabalacat City, Pampanga for lack of jurisdiction.
“SO ORDERED,” the decision furthered.
Under Section 61 (a) of Republic Act No. 7160 states that “a complaint against any elective official of a province, a highly urbanized city, an independent component city or component city shall be filed before the Office of the President.”
The 2-page decision dismissing Mayor Garbo’s administrative case was signed by Vice Governor Lilia Pineda and Board Members Rolando “Pol” Balingit, Fritzie David-Dizon, Sajid Eusoof, Atty. Ananias Canlas Jr., Benjamin Jocson, Atty. Claire Lim, Nelson Calara, Cherry Manalo and Johnny Carlo Cruz.
